The Association
The Association is a non-profit corporation founded on October 11, 1979, to provide for the preservation, management, maintenance, improvement, and care of the architecture and appearance of the common areas of Newcastle Manor, for the benefit of all members of the Association. Common areas include all parts of the property and buildings except the insides of each unit.
The Association sets an annual budget and rates for dues; collects dues; and manages and pays for maintenance, repairs, and renovations of the common areas and facilities, including the gyms, pools, laundry rooms, lobbies, and elevators. In addition, the Association imposes and enforces rules to ensure harmonious, peaceful, and safe living in our community. The Association does not manage or maintain the individual units.
The Association does not get involved in disputes between residents or owners. In addition, the Association has no authority to restrict or expel owners, nor to evict renters, regardless of the noxiousness of their behavior or the extent to which they violate rules. The Association's enforcement power for violations of the Rules and Regulations is limited to imposing fines and assessments, and, in extraordinary circumstances only, entering a unit to perform repairs in cases of long-term neglect which impact the common areas.
Governing Documents
Governance of the Association is controlled by:
- Covenants, Conditions, and Restrictions (CC&Rs);
- By-Laws;
- Rules and Regulations; and
- Additional stand-alone operating rules
all of which are subject to restrictions and requirements imposed by California law. All members must have copies of these documents, and must understand and abide by them. If you are an owner of a condominium at Newcastle Manor and do not have these documents, download them here.
Members
Members of the Association (owners of condominium units) are responsible for paying dues and assessments on time, maintaining their units, knowing and abiding by the Rules and Regulations, and voting in elections. Members that rent out their units are responsible for their tenants' knowing and abiding by the rules; Members are accountable to the Association for violations of the rules by their tenants.
Board of Directors and Officers
The Board of Directors comprises seven volunteer Members, who are elected or appointed to serve two-year terms. The Board sets policy and makes management-level decisions for the benefit of the membership. The Board is ultimately responsible for achieving the objectives of the Association. Managing Agent
The Association has a professional managing agent on contract to execute day-to-day management tasks, and provide the first point of contact for Member services, to include after-hours emergency maintenance requests. The managing agent handles billing and collection of dues and assessments, pays bills, maintains financial records, provides accounting reports, and manages relationships with third-party service providers and vendors. All tasks delegated to the managing agent are performed by direction of the Board. The Managing Agent may also be referred to as the Management Company, Property Manager, or Property Supervisor.
Maintenance Staff
The Association has full-time on-site maintenance men, employed directly by the Association. Their job is to perform maintenance and repair on the common areas, and observe and report violations of the Rules and Regulations. Please note the employees answer to Association officers only, and not to individual Members or residents.
Night Watchman
The Night Watchman is contracted by the Association to patrol the property to observe and report violations of the Association's Rules and Regulations (such as excessive noise, misuse of pools or barbecue areas, improper garbage disposal, and parking). The Night Watchman is not responsible for dealing with issues that are not the Association's business (such as claims of harassment or disputes between neighbors).
The Night Watchman will take reports from residents regarding violations of the Rules and Regulations, as well as the presence of suspicious characters or activity that residents believe may pose a threat to safety or property, so he may tailor his patrols and reporting accordingly. While the Night Watchman will call the police if he witnesses a crime in progress as any citizen would, he is not to be considered the first responder for crimes or other emergencies you may observe. If you believe criminal activity is imminent, a crime is in progress, or a crime has just been committed, and you desire assistance, you should contact the LAPD directly.
