Prerequisites

If you have been a victim of a crime or are involved in a civil action, the Association will provide relevant video evidence that may have been captured by the video surveillance cameras, according to the procedures described on this page.

To obtain video evidence that may have been captured regarding an alleged crime, you must first report the crime to the police, and obtain a copy of the police report. Click here for information on reporting crimes.

For civil actions, such as a car accident in the parking lot, you may provide one of the following documents relating to the incident. A letter from an attorney, by itself, is not sufficient.

  1. Notice of a claim from your or the other party's insurance company.
  2. A police report.
  3. DMV Form SR 1.
  4. Court filing.

Once you have the required documentation, contact the Night Watchman using the instructions below. The Night Watchman will provide further instructions.

If your civil action is against the Association, then this page does not apply; your attorney will need to contact the Association's attorney regarding whether and how video recordings will be shared with you.

Additional Information

The Association does not guarantee coverage or uptime for surveillance cameras, and bears no liability or responsibility for crimes committed against residents or their property. In cases of a dispute between members of the Association or tenants, all parties will be entitled to a copy of the video once anyone involved has met the prerequisites above, to avoid appearance of partiality on the part of the Association.

The Association has limited space for storing video, and older saved video is continuously overwritten by new video. So if you believe you will need a copy of video evidence but do not yet have the required documentation, contact the Night Watchman and provide a description of the date, time, and/or event for which you may need video, so that he may set it aside until such time as you can provide the required documents. All video will be saved on a best-effort basis, and the Association makes no guarantee that recordings of any given time or event will remain available for any period of time, even if you made a request to keep it.

The Association may choose to share video with law enforcement in the event a crime has been committed on or near our property, regardless of whether a unit owner or tenant has requested it.
